Rights to sell
In consigning items for sale the vendor or the agent of the vendor warrants that the items are rightfully theirs to sell, with no financial or legal encumbrance thereon.
Reserves
In most instances a reserve price will be agreed. The auctioneer may, at his sole discretion, sell an item below this figure but, in doing so agrees to forward to the vendor that amount which would have been due had the lot sold at the agreed reserve.
Pre-sale advice
A confirmatory pre-sale advice letter or e-mail will be sent a few days prior to the sale date. This will include the lot number, description and reserve price of each lot as it will appear in the catalogue and on the websites. Unless notice is given to the contrary it is assumed that the vendor or agent of the vendor approves the pre-sale advice.
Settlement
Sale proceeds are usually made about three weeks after the sale date, provided that full cleared payment has been received from the buyer(s) of the vendor’s lot(s).
Sale proceeds will be made by bank transfer, unless specific arrangement has been made for payment by a different method. Bank charges for payments to overseas accounts will be deducted from proceeds.
Charges
Commission is charged at 15% of the hammer price plus VAT at the standard rate, with a minimum commission of £8.33 plus VAT per lot.
Indemnity against loss or damage is charged at 1.5% plus VAT of the hammer price. This indemnity is limited to the value of the pre-sale mid estimate.
Illustrations which appear in the catalogue and/or on the websites which host the catalogues are charged at £ 18.00 plus VAT per lot, regardless of how many images are taken of each lot. Illustrated lots which sell for less than £ 360.00 (hammer price) will be charged at 5% of the hammer price plus VAT. Further illustrations used in additional advertising will be charged at cost.
There are no charges for unsold lots with agreed reserves. Unsold lots will be re-assigned to a later sale, usually with an adjusted reserve. Semley Auctioneers reserve the right to charge 15% plus VAT of the pre-sale mid estimate and any other charges relating to an unsold lot where the reserve price has not been agreed with the auctioneers.
